2. Purpose and Scope of Application

These Terms of Use of the website www.atleticobaleares.com are intended to regulate the provision of and free access to the website for the general public, and for Atlético Baleares supporters in particular, to sporting, institutional and social information, as well as to the products and services offered by ATB or by third-party sponsors and/or collaborators of the Club that may be of interest to the user.

The user is subject to the policies and conditions in force at the time of using this website, except where changes to such policies or conditions must be applied retroactively by law or by decision of the competent authority. In this regard, ATB reserves the right to make, at any time and without prior notice, modifications and updates to the information contained on the website, its configuration, presentation and conditions of access. Users are therefore advised to consult this Legal Notice regularly.

The mere use of and browsing through the website, as well as requesting information or, where applicable, registering and purchasing certain products and/or services (for example, purchasing tickets for sporting events), implies the user’s acceptance, without reservation of any kind, of each and every one of these General Terms and Conditions of Access and Use and, where applicable, the terms governing registration and contracting.

3. Provision of the Service

The Club does not guarantee that access to the website or its content will be uninterrupted or error-free, nor that it will be free from viruses or any other elements that may cause alterations to the user’s computer system. Whenever possible, and provided that the required tasks are not excessively difficult to carry out, ATB will do everything necessary to restore communications and correct errors as soon as it becomes aware of any errors, interruptions or outdated content.

The Club shall not be liable for any damage arising from interference, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operation of this electronic system or in users’ computer equipment caused by circumstances beyond ATB’s control that prevent or delay the provision of services or browsing of the website. Nor shall the Club be liable for delays or interruptions caused by deficiencies or overloads affecting the Internet or other electronic systems, or for the impossibility of providing the service or allowing access due to causes not attributable to the Club, including those attributable to the user, third parties or events of force majeure.

4. Information Provided on the Website

Should any error be detected at any time in the information published on the website, it shall be corrected immediately. Likewise, the contents of the website may, on occasion, be displayed as provisional information.

5. Intellectual and Industrial Property

However, the Club accepts no responsibility for the existence of links between third parties and websites unrelated to ATB. The links provided on the Club’s website are for information purposes only and shall under no circumstances place the Club in the position of guarantor and/or provider of the services and/or information offered by third parties through such links.

Accordingly, ATB declines any responsibility for the services and/or information provided on other websites linked to this website. The Club neither controls nor exercises any supervision over the websites to which it provides links from www.atleticobaleares.com. Furthermore, the inclusion of links to other websites shall in no way imply responsibility for, or ownership of, their contents, nor shall it be understood as any form of supervision or approval of any changes or information published therein. ATB recommends that users visiting the websites referred to consult the legal terms and conditions that may apply to them.

The inclusion of hyperlinks for advertising, commercial or association purposes on third-party websites that allow access to the ATB website without the prior consent and/or express authorisation of the Club is expressly prohibited. 10. Disclaimer of Liability of ATB

Under no circumstances shall ATB be liable for any of the following circumstances, which are listed by way of example and not limitation, or for any damages arising therefrom, since it can neither control nor guarantee them: (a) possible security errors resulting from the use of computers infected by computer viruses; (b) the use by third parties of elements owned by the Club that may cause confusion as to its identity; (c) infringements of intellectual and industrial property rights committed by third parties; (d) breaches by third parties that may affect users of the ATB website; (e) the unavailability of the website or any of its services due to causes beyond the Club’s control; and (f) consequences arising from the malfunction of the user’s browser or from the use of outdated versions thereof.

ATB shall not be liable for users’ failure to comply with the terms of this Legal Notice, nor for the use of the services and content accessible through the website. Any loss or damage resulting from the impersonation of a third party by a user in any communication made through the website shall be the sole responsibility of the person carrying out such impersonation, since the Club does not control the authenticity of the content or information provided by users of the website.

11. Privacy Policy. Protection of Personal Data

In accordance with Organic Law 15/1999 of 13 December on the Protection of Personal Data and the applicable implementing legislation, the personal data of users accessing the website www.atleticobaleares.com shall be incorporated into an automated file for which ATB, with registered office at C/ Gregorio Marañón 1, 07007 Palma de Mallorca, is responsible. Said file shall be treated as confidential for the purpose of sending users communications related to their status or relationship with the Club (member, supporters’ club member, “ATB Fan”, etc.), concerning the sporting, social and institutional activities of ATB, as well as offers of products and/or services from the Club itself or from collaborating entities that have entered into agreements with ATB and may have special offers of interest to members, supporters and Internet users who have provided their personal data. Users also accept that ATB may disclose their personal data to collaborating third-party entities so that such entities may send them commercial or promotional offers and/or communications relating to products or services that may be of interest to them.

However, adult users, and in the case of minors, their legal representatives acting on their behalf, may exercise at any time their rights of access, rectification and/or cancellation by sending a written request, together with a photocopy of their identity document and, in the case of minors, additionally a photocopy of the minor’s identity document (where applicable), to the data controller, CD Atlético Baleares, at its registered office: C/ Gregorio Marañón 1, 07007 Palma de Mallorca, or by email to info@atleticobaleares.com, clearly stating the right they wish to exercise and the reasons for their request.

ATB has the technical knowledge and resources necessary for the computerised processing of databases and the provision of certain services, and has implemented the security mechanisms required to ensure the proper protection and security of personal data in accordance with the applicable data protection legislation in force.

14. Applicable Law and Jurisdiction

These Legal Terms shall be governed by the applicable laws of the Balearic Islands, Spain and international law.

Should any conflict or dispute arise regarding the interpretation or application of these Legal Terms, the courts having jurisdiction shall be those determined by the applicable legislation on competent jurisdiction, which, in the case of consumers, shall generally be the courts of the place where the obligation is to be performed or of the user’s place of residence.

If the user is domiciled outside Spain, or where the transaction consists of a purchase made by a company, both parties expressly waive any other jurisdiction to which they may be entitled and submit to the Courts and Tribunals of Palma de Mallorca (Spain).
